Minutes of the meeting of October 19, 2009
A meeting
of the Board of Adjustment of Alexandria Township was held on the 19th Day of October
2009 at the Alexandria Township Conference Room, 610 Fillmore Street.
ROLL
CALL: Members present were Bryon
Alstead, Joel Dahlheimer, Louis Ross and Roger Thalman. Also present were Deputy Clerk Bonnie Fulghum
and Zoning Administrator Ben Oleson.
Landscape
Creations, represented by Scott Giroux, appealed the after-the-fact fee of $750
assessed by the township for work begun on a project prior to the issuance of a
permit.
Zoning
Administrator Oleson stated that he and Mr. Giroux had met on-site (1202 Maple
Drive SE) on August 12, 2009 to discuss the project. At that time, Oleson felt the project initially
met the zoning regulations; however, he informed Mr. Giroux that he would need
to apply for a permit. September 8,
2009, Oleson contacted Mr. Giroux and
said that the township had not yet received a permit application. He also inquired if Landscape Creations was
proceeding with the project. Oleson
verified via a site visit that the work was almost complete. Mr. Giroux submitted an application on
September 9, 2009. It was not considered
complete until September 10, 2009, when the applicant provided an actual site
plan showing the location and type of work to be done.
Oleson
explained to the applicant that township policy requires after-the-fact permits
to be charged a late fee of $750 and/or restoration of the site. He told the applicant there were two options,
1) to pay the fee or 2) to appeal to the Board of Adjustment.
Chairman
Thalman asked the applicant for comment.
Mr. Giroux contended that he had obtained preliminary approval and,
since he had other work in the area, they began the project.
Alstead,
seconded by Ross, made a motion to waive the after-the-fact fee for Landscape
Creations. Roll: Alstead, Ross, Thalman – yes. Dahlheimer – no. Motion carried.

adjourned at 6:40 p.m.
